General Terms for Consumers
2025-01-13
1. Parties, Application and Contact
These terms apply between Cupboards & Goods and you as a consumer for distance purchases for delivery within Sweden. B2B purchases are regulated separately.
2. The Products
Modular products are manufactured to order and are not held in stock. Therefore, no right of withdrawal applies, even for the standard range. Some projects are bespoke.
Colour and texture variations may occur. Images are for inspiration; deviations in colour/grain may arise.
3. Prices, Payment and Ownership
Prices in SEK including VAT. Shipping is additional unless otherwise stated.
Payment for modular products: 50% at order, 50% no later than 14 days before dispatch. Bespoke: same model unless otherwise agreed in writing.
Ownership remains with the seller until full payment is received.
4. Order Process and Order Freeze
The order becomes binding upon written order confirmation. You approve documentation before production starts (Order Freeze). Changes after this may incur additional costs and affect delivery time.
5. Delivery
Delivery is normally to kerbside/entrance. Carrying, unpacking and assembly are not included unless otherwise agreed. You are responsible for ensuring access. Missed delivery may result in additional charges.
Risk transfers to you upon physical delivery. In case of delayed delivery, a new time will be communicated. Your statutory remedies apply. Storage costs may apply if delivery is postponed at your request.
6. Right of Withdrawal
Right of withdrawal does not apply to made-to-order products. Right of withdrawal under the Distance Contracts Act applies only to stocked goods in essentially unchanged condition.
7. Cancellation Before Delivery
Cancellation is possible, but the seller is entitled to reasonable compensation for incurred costs: materials, supplier fees, project planning, etc. The deposit is offset; if costs exceed the deposit, you shall pay the difference.
8. Bespoke Products
Goods produced to your specific instructions (custom dimensions, constructions, cutouts, non-standard components) are not subject to any right of withdrawal. Order Freeze occurs upon written approval of documentation.
9. Inspection, Defects and Complaints
The goods shall be inspected upon receipt. Defects must be reported within a reasonable time.
Right to complain: 3 years from delivery. Defects within 2 years are presumed to have existed at the time of delivery.
Remedy: repair or replacement in the first instance, then price reduction or rescission. Damages may be available under statutory rules.
10. Care and Use
Care instructions must be followed (moisture, temperature, cleaning, protection against standing water). Damage from abnormal use or inadequate care is not covered by the seller's liability.
11. Limitation of Liability
Indirect and consequential damages are not compensated to the extent permitted by law. Total liability per purchase is limited to the amount paid, except for liability that cannot be limited under mandatory law.
12. Force Majeure
Delays caused by circumstances beyond reasonable control (strikes, pandemics, government decisions, supply chain disruptions) are exempt from liability. If an impediment lasts more than 60 days, both parties have the right to rescind with refund.
13. Personal Data
Data is processed in accordance with the Privacy Policy. Supervisory authority: Swedish Authority for Privacy Protection (IMY), www.imy.se. We only collect national ID numbers where necessary (e.g., credit checks).
14. Dispute Resolution, Applicable Law
Swedish law applies. Disputes may be reviewed by the National Board for Consumer Disputes (ARN), general courts, or via the EU's ODR platform. Mandatory consumer rights are not affected.
15. Changes to the Terms
The terms may be updated. The version in effect at the time of order applies to that purchase.
