General Terms and Conditions

 

Company information and contact information

These general terms and conditions (the “Terms”) apply to all purchases made by the customer (“you”) via this website from Cupboards and Goods Sweden AB, 559236-5042, VAT registration number SE559236504201, Erik Dahlbergsgatan 3, 411 26, based in Gothenburg, (hereinafter “we”, “our” or “us”).

If you have any questions about our products, your purchase or these Terms, you can contact our customer service at order@cupboardsandgoods.com. You can also send a letter to our address above marked “Customer Service”.

 

General

By placing your order, you enter into an agreement with us, in accordance with these Terms. When you place an order, you will receive confirmation that you have been given the opportunity to take advantage of these Terms.

By making a purchase, you confirm that you are of legal age (18 years or older), are not under trusteeship, or have the right to make this purchase.

(2)

We reserve the right to change these Terms. The Terms in the version that is current when you make a purchase are the Terms that apply to each purchase.

Order

Before you complete your order, you will be given the opportunity to review it and change or cancel your order. After you have completed your order, an order confirmation will be sent to the e-mail address you provided.

When you click on “confirm” or equivalent, a binding order will appear and you undertake to buy the products you have added to your shopping cart. A binding agreement has been entered into when your order confirmation has arrived to you.

For your right to repent, see paragraphs 15-16. Please note that the purchase of specially ordered kitchen fittings or custom-made products cannot be undone, see item 20.

Price and payment

All prices are stated in Swedish kronor (SEK) including VAT. Delivery fee may apply and in that case be stated with the amount before you complete your order.

Payment can be made against invoice or via credit or debit card. Specially ordered kitchen fittings or other custom-made products are paid for with half when ordering (in advance) and half upon delivery. Please note that we do not start work on your specially ordered kitchen fittings until we have received your advance payment. All other products are paid in advance in connection with ordering.

Delivery

Your products will be delivered to the address you provided when ordering or, if you have chosen, will be available for collection with us.

The delivery times stated by us are approximate, especially with regard to specially ordered kitchens (see point 22). However, we always strive to be able to deliver as soon as possible.

(10)

A specially designed kitchen fitting or custom-made product is usually ready for delivery within eight weeks.

Reclaim

You always have the right to report defective products within three (3) years of receipt of your products, provided that you notify us of the defect within a reasonable time after you discovered the defect. Complaints made within two (2) months from the time you discovered the error are always considered to have been submitted within a reasonable time.

If the products you returned can be deemed defective, we will make a full refund corresponding to your purchase price for the products, together with the delivery costs for these. In order for a product to be assessed as defective, the defect must have occurred before the time of sale. If you complain about a defective item within six (6) months from the time of sale, the defect is considered to have occurred before the time of sale, unless this can be disproved by us. However, if the complaint occurs more than six (6) months after the time of sale, you are obliged to submit proof showing that the error occurred before the time of sale.

Right of withdrawal

You have the right by law to cancel your purchase within fourteen (14) days from the time you received the product from us, without giving any special reason, and return the product you have purchased. If you want to exercise your right of withdrawal, you must contact us within this time, by sending us a clear and distinct message by e-mail or letter stating who (name) regrets their purchase, of which product (s), when ordering was made, address and date when you send the message (if by letter). You can also use the standard form that can be downloaded from the Swedish Consumer Agency’s website (www.konsumentverket.se) and send it to us, but this is not a requirement. Our contact information is at the top of these Terms.

If you exercise your right of withdrawal, you are obliged to return without undue delay, and no later than fourteen (14) days from the day you notified us of your desire to exercise the right of withdrawal, all products for which you wish to exercise your right of withdrawal. We will refund all payments we received from you for the canceled purchases, including delivery costs (apart from increased delivery costs due to you choosing a delivery option that does not correspond to the lowest priced standard option we offer for the delivery in question) as below.

Refunds and returns

Refunds are made automatically using the same payment method used to pay for your products. If the payment was made by invoice or by advance payment, the refund will be made to the account from which the payment was made. If necessary, we may therefore need to ask you for your account information. If you paid by credit card, the refund will be made to your credit card.

If your product is defective, or if you have exercised your right of withdrawal, we will bear the cost of the return delivery. You can use the return note that came with the product delivery or contact us to receive a new return note. In the event that you do not use our return slip, you will be responsible for the return cost.

However, a condition for full refund is that the product is returned in the same condition as it was when you received the delivery. If a decrease in value can be found to have occurred due to your handling of the product, you are obliged to replace it. If the product is not returned in such condition, we have the right to refuse your return or reduce the amount we have to pay back to you.

Especially about specially ordered kitchen fittings

If you have ordered kitchen fittings, or individual custom-made products, from us, the right of withdrawal does not apply. The kitchen interior refers to a service (assembly and special adaptation) we start with your order and refers to an item that in some cases is manufactured according to your special instructions. By law, the right of withdrawal does not apply to such products. When you complete an order that contains a product that cannot be undone, you will be notified of this.

The colors of your specially ordered kitchen fittings may differ slightly from the samples you have come in contact with. This is because each unit is made especially for you and the different materials used.

If you have a reclaim about a kitchen fittings from us, and the product in the fittings is of such a nature that it cannot be conveniently returned to us by post or courier, you will instead of using a return slip be contacted by our customer service for handling the collection of the product.

We expect a delivery time of eight weeks, unless we have specified otherwise for a specially equipped kitchen. However, we ask you to note that this is an approximate delivery time and the exact delivery date can in any case not be determined when ordering, as it depends on how many orders we have in stock and stock status with our subcontractors. However, we strive to keep you continuously informed about our estimated delivery time and you can always contact our customer service for updates.

Personal data processing

When you make a purchase with us, we will process your personal information, in the form of name, social security number, address, delivery address, contact information (preferably telephone number and e-mail address) and your payment information (such as credit card number).

We will only process your information to administer the purchase, for the purpose of fulfilling the agreement we have entered into with you. We will not share the information with third parties, in addition to the necessary information to; the transport company that assists us with the delivery of your products; the technology provider that helps us with the operation, monitoring and protection of the website and our IT environment; and the technology provider that helps us handle your payment. We will not save the information longer than necessary for the purchase to be completed, to be able to handle any reclamations or exercise of the right of withdrawal from you, and for us to be able to fulfill our accounting obligation. Only those people with us who need access to your personal information in order for us to be able to implement the agreement will have access to them. We have the usual and adequate IT security in place, to prevent unauthorized use or that any unauthorized person accesses your personal data.

You always have the right (with certain restrictions) to exercise the following rights, which you do by contacting us as above. If you wish to exercise these rights, we may request that you first prove your identity and / or provide information that will enable us to identify information we process about you.

  • Objection to our processing of your personal data. In certain circumstances, you may object to our processing of your personal data. In the event of such a circumstance, we discontinue all processing regarding you, for the purpose you want us to discontinue the processing.
  • Request that our processing of your personal data be restricted. In certain circumstances, you may request that our processing of your personal data be restricted. In the event of such a circumstance, we will discontinue all processing regarding you, according to the restriction you want us to apply.
  • Receive information about our processing of your personal data. You will then receive a description and a copy of your personal information that we process regarding you.
  • Request that your personal data be deleted (right to be forgotten). We will then delete all personal data concerning you that we process, if we do not have to store your data according to a commitment we have, for example due to law or agreement.
  • Request that any incorrect information regarding you be corrected. We will then correct the incorrect information.
  • Withdraw your consent. In the event that our processing of your personal data is based on your consent, we will discontinue all processing and delete your data regarding all consent-based processing, in the event that you notify us that you are revoking your consent.
  • Complain about our treatment to Datainspektionen, https://www.datainspektionen.se.

It costs nothing to exercise your rights. However, if your request is manifestly unfounded or unreasonable (for example, unnecessarily repetitive), we reserve the right to charge a reasonable administrative fee or to refuse to comply with your request.

 

Law, disputes and notification to the General Complaints Board

These Terms and the agreement between you and us are governed by Swedish law. Disputes arising from these Terms shall be settled by a general court in Sweden.

However, you as a consumer are also entitled, if you have a complaint about a purchase which could not be resolved through direct contact with us, to turn to an alternative dispute resolution body. Applying to an alternative dispute resolution body is generally cheaper, less formal and faster than going to court. You can only use this option if you are resident in the EU. You can either use the online complaint platform available on the European Commission’s website, www.ec.europa.eu/odr, or contact the General Complaints Board directly, www.arn.se. The General Complaints Board is an approved board for alternative dispute resolution in consumer disputes.
